This paper aims to analyse the agreements between lawyers and their clients that establish professional fees, from the perspectives of the principle of private autonomy and the requirement of the written form ad substantiam. In particular, the contribution focuses on the dual structure of Article 13(2), Law no. 247 of 2012, in order to gain a better understanding of its ratio and to overcome the interpretive issues raised by the doctrine and the jurisprudence of legitimacy, thus corroborating the conclusions reached by the Supreme Court.
