Abstract
The Constitutional Court ruled on the legitimacy of a legal provision that prohibited candidates from seeking election for a third consecutive term as council members of district bar associations, confirming the case law of Joint Divisions of the Supreme Court of Cassation. The regulatory content that the legislator has attributed to the ban on re-election for a third consecutive term is critically assessed in the light of the principles and core values of the rule of law, such as in particular the principle of reasonableness, the protection of legitimate expectations, the consistency and certainty of the legal system.File | Dimensione | Formato | |
